Agents, brokers & lenders
What is dual agency, and should I agree to it?
The short answer
Dual agency is one agent (or brokerage) representing both buyer and seller in the same deal. It halves the duty owed to each side and is illegal in several states, consent-required in most others. It occasionally makes sense for a simple deal between informed parties — but never agree under pressure, and never without asking what you're giving up.
